GDPR
The GDPR enters into force EU-wide on May 25, 2018. The GDPR is a regulation of the European Union which improves and harmonizes the regulations on data protection across the EU. The GDPR requires companies to disclose in an open and transparent way how personal data is collected, stored, and used.
ThinkLABs has already implemented GDPR requirements. We have revised our privacy policy supplemented our clearly understandable instructions for end users published our list of subcontractors and created an Opt-Out option.
Basics:
We assume that the affiliate tracking can contain personal data and therefore the GDPR applies.
We see a legitimate interest in offering our services. The services provided by ThinkLABs and the resulting cookies of the affiliate networks and advertisers are based on Article 6 letter f GDPR. The website operator has a legitimate interest in this, since the amount of its affiliate remuneration can be determined only through the use of cookies.
We see ourselves as order data processors
Recommendations:
In the following, we would like to give you some recommendations for action. But we emphasize that this does not constitute legal advice and we take no responsibility for its correctness.
Verify if, where and how you process personal data on your site. Please note that the IP address of users is considered personal data..
Update your privacy policy. Tip: There is a configurator for this purpose on eRecht24.
Complete our Order Processing Contract and send it signed by e-mail to the adress stated inside the .PDF document.
Add a paragraph to your privacy policy that explains your collaboration with ThinkLABs and offers opt-out options. The following provides an example:
ThinkSuggest by ThinkLABs
The operators of this website use the service ThinkSuggest of ThinkLABs. ThinkLABs is a service provider who develops marketing solutions and supports website operators to generate advertising revenue. The products of ThinkLABs have no influence on the contents provided by the website operator. They work purely context-sensitive (content-related), e.g. based on search intent. If a user clicks a link to an external page, ThinkLABs automatically checks whether an affiliate / partner link can be generated from this link where the website operator can earn money through advertising cost reimbursement. If this is the case, you will be forwarded to the advertiser via its affiliate program, who may operate it in an affiliate network. For this purpose, the advertiser or the affiliate network will install a cookie in order to trace the origin of the order. This allows the advertiser to recognize that you have clicked the partner link on this website.
The services provided by ThinkLABs and the resulting cookies of the affiliate networks and advertisers are based on Article 6 letter f GDPR. The website operator has a legitimate interest in this, since the amount of its affiliate remuneration can be determined only through the use of cookies.
Further information on the use of data by ThinkLABs, as well as the option of an opt-out, can be found in the privacy policy of ThinkLABs.
